ATM system. This move was followed by the conclusion
of a Memorandum of Cooperation between
EUROCONTROL and the European Commission in
December 2003, establishing a framework for
mutual cooperation and support in five areas:
implementation of the Single European Sky,
research and development, data collection and
analysis in the areas of air traffic and environmental
statistics, satellite navigation and international
cooperation in the field of aviation.
As with the Revised Convention, certain provisions
of the EC Accession Protocol are subject to early
implementation.
A few States have yet to ratify the Revised
Convention and/or the EU Accession Protocol,
although all are expected to have done so by the
end of 2006.
RATIFICATION OF THE REVISED
CONVENTION
The EUROCONTROL Convention of 1960, which is
the Organisation’s legal basis, was revised in 1997
to take account of changes in the political and
operational environment of ATM, within which the
Agency operates. Early implementation of certain
provisions of the Revised Convention has enabled
EUROCONTROL to take initiatives to accelerate
the delivery of an improved, safe and efficient ATM
system and to improve and streamline decisionmaking.
Changes to the management structure
included the establishment of new decision-making
bodies: the EUROCONTROL Commission and
the Provisional Council, which will be called the
EUROCONTROL General Assembly and the
Council respectively, once ratification is complete.
The ratification of the Revised Convention by all
the Member States will have a beneficial effect on
the decision-making process, as the voting system
of EUROCONTROL’s supreme body, the Council,
will change from one in which decisions require a
unanimous vote, to one requiring a majority. In
addition, the European Community, represented
by the European Commission, will become a full
member of EUROCONTROL, as a result representing
EU Member States in key issues. Overall, full
ratification will significantly ease the path towards
the achievement of EUROCONTROL’s objectives
of a safe, efficient and reliable ATM system.

SAFETY
States are required to report safety data on aviation
accidents, incidents and occurrences in
accordance with the EUROCONTROL Safety
Regulatory Requirements (ESARR 2). The PRC has
highlighted, however, that serious inadequacies
exist in the quality, quantity and consistency of
safety data. As a result, it has so far not been in a
position to objectively measure safety indicators
and trends across Europe.
The PRC focused its recommendations in 2005 on
this particular issue and proposed a threepronged
approach:
❚ to establish a proper safety-data flow, addressing
legal and/or cultural impediments to incident
reporting as required. The Director
General established the Safety Data Reporting
and Data Flow Task Force (SAFREP) to this
effect;
❚ to develop key performance indicators for safety,
which the PRC undertook with specialist
assistance;
❚ to set up a Europe-wide review system for ATM
incidents.
In 1997, the signatories of the Revised Convention
agreed to determine policies to develop the
capacity needed to meet all user needs in a costeffective
manner while maintaining the required
level of safety. They committed themselves to the
establishment of specific performance targets and
of a performance-review and target-setting system
(Art. 1.1).
Consequently, the Performance Review Commission
(PRC) was created in 1998 to advise the
Provisional Council. It is supported by the
Performance Review Unit (PRU).
The following section contains a summary of PRC
findings concerning the performance of ATM in the
EUROCONTROL Organisation, under the key performance
areas of safety, capacity, flight efficiency
and cost-effectiveness, which, together with security
and the environment, form the substance of
this report. The Performance Review Report covering
year 2005 (PRR 2005) and other PRC reports
can be found on the EUROCONTROL website
(www.eurocontrol.int/prc).
Further sections of this report describe the contribution
of the EUROCONTROL Agency to improvements
in these key performance areas.

CAPACITY
The PRC reports that major progress has been
achieved in the reduction of delays and en-route
capacity is now at near-optimum levels. The cooperative
