We provide a brief description of the pension scheme hereafter in Note 1 to the annual accounts of the Fund, a
description of the funding policy in Note 2 and details on the structure of the Fund (sub-accounts) in Note 3.
The present report is published in accordance with Article 7.d of the Regulations of the Pension Fund.
1.2 Governance and administration
Pension Fund Supervisory Board: renewal as of 01.09.08
The Pension Fund Supervisory Board was constituted on 01.09.05 by Measure No. 05/111 of the Permanent
Commission. The appointment of the Chairman of the Board was ratified on 23.11.05 by Measure No. 05/115.
The members of the Board were appointed for a period of three years, until 31.08.08. The Board until 31.08.08
was constituted as follows:

On 01.09.08, the Permanent Commission renewed the Supervisory Board membership by Measure No. 08/145
and appointed the Chairman and the Vice-Chairman of the Board by Measure No. 08/147. The number of members
representing the States and the staff has been increased from three to four and the duration of the mandate
from three years to four, in order to enable a renewal of half of the Board every two years, with a view to ensure a
certain continuity within the Board. For the first implementation of this two yearly rotation, half of the members were
appointed for a duration of four years and the other half for two years. The Board membership as from 01.09.08
was as follows:
(1) First appointment for a period of two years in view of a rotation of half of the Board every two years.
The Board is independent from the Agency and reports to the Provisional Council. It is assisted by the Fund
Executive Officer who is an official of the Agency. The responsibilities of the Board are stated in Article 7 of the
Regulations of the Pension Fund as follows:
n Supervise the management of the Fund;
n Set the Fund’s Statement of Investment Principles and define the Investment Strategy, after considering the
Provisional Council’s views;
n Monitor on a regular basis the investments and the related risks to ensure compliance with the Statement of
Investment Principles and the Investment Strategy;
n Approve the annual report of the Fund, including the annual accounts of the Fund to be forwarded to the
Permanent Commission via the Provisional Council;
n Report at least annually on its review of the Fund to the Provisional Council and to the members and beneficiaries
of the Fund;
n O n a regular basis, but at least once every five years, the Supervisory Board shall carry out a thorough review of
the Fund’s investment policies, goals, guidelines, performance, actuarial assumptions, rates of contribution and
capitalisation target, and shall report its findings, decisions and recommendations to the Provisional Council.

Fund Executive Oficer: full time as from 01.04.08
Mrs Sabrina DEPICKER, assigned to this duty in 2005 by the Director General, in agreement with the Pension Fund
Supervisory Board pursuant to Article 9 of the Regulations of the Pension Fund, assisted the Board from 01.01.08
till 31.03.08 in addition to her other responsibilities within the Agency. As from 01.04.08, Mr Pierre DEPIREUX was
appointed Fund Executive Officer on a full time basis.

Change in legal basis: revision of the Fund Regulations
Further to the recommendations made by Internal Audit and the Audit Board, the Supervisory Board revised the
Regulations of the Fund to bring them into line with the OECD best practices for the governance of pension funds.
